Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the GymNext mobile application, related software, connected hardware, websites, and services, including features that generate content using artificial intelligence or machine learning systems (“AI Features”) (collectively, the “Services”).
The Services are provided by 1804282 Ontario Limited, operating as GymNext (“GymNext,” “we,” “our,” or “us”), a corporation organized under the laws of Ontario, Canada.
By accessing or using the Services, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services. If you are under 18, you may only use the Services with the consent of a parent or legal guardian.
2. Account Registration
2.1 You may create an account or use certain features as a guest.
2.2 You agree to provide accurate and complete information when creating an account.
2.3 You are responsible for maintaining the confidentiality of your login credentials.
2.4 You are responsible for all activity that occurs under your account.
2.5 Account Deletion: You may delete your account at any time within the application by navigating to My Profile > Delete Account. Upon deletion, your account and associated data will be removed in accordance with our Privacy Policy, except where retention is required for legal or operational purposes.
3. Subscriptions & Payments
3.1 Certain features require a paid subscription.
3.2 Subscriptions renew automatically unless cancelled before the renewal date.
3.3 Subscription billing is handled through the applicable app store platform (Apple App Store, Google Play) or direct payment processor.
3.4 Pricing, features, and availability may change at our discretion.
3.5 Failure to maintain an active subscription may result in loss of access to premium features.
3.6 Refunds: All subscription purchases made through Apple App Store or Google Play are subject to their respective payment and refund policies. GymNext does not issue refunds directly for in-app purchases. You must contact the applicable platform provider for any refund requests.
4. Device Integration
4.1 The Services may connect with GymNext hardware products and third-party platforms (e.g., Apple Watch, AirPlay, Google Cast).
4.2 Compatibility is not guaranteed across all devices, operating systems, or firmware versions.
4.3 You are responsible for maintaining compatible hardware and software.
5. Acceptable Use
You agree not to:
- Use the Services for unlawful purposes
- Reverse engineer, decompile, or attempt to extract source code
- Interfere with or disrupt the Services
- Circumvent security measures
- Share your account credentials with others
We reserve the right to suspend or terminate accounts that violate these Terms.
6. Health & Fitness Disclaimer
The Services are intended for fitness and training purposes only.
GymNext does not provide medical advice.
You should consult a physician before beginning any exercise program.
You assume all risks associated with physical activity.
GymNext is not responsible for injury, health complications, or damages arising from use of the Services.
7. AI-Generated Content & Features
7.1 The Services may include AI Features that generate workouts, timers, configurations, recommendations, or other fitness-related content.
7.2 AI-generated content may be inaccurate, incomplete, unavailable, delayed, or unsuitable for certain users, fitness levels, health conditions, or equipment setups.
7.3 AI-generated content is provided for informational and convenience purposes only and does not constitute medical advice, diagnosis, treatment, coaching advice, or other professional guidance.
7.4 You should consult a physician or other qualified professional before beginning, modifying, or relying on any workout, timer, configuration, recommendation, or other content generated by AI Features, as appropriate to your circumstances.
7.5 You are solely responsible for reviewing, validating, and adapting any AI-generated content before use, including determining whether it is safe and appropriate for your health, fitness level, experience, environment, and equipment.
7.6 Use of AI Features is at your own risk. By using any AI Features, you acknowledge and accept that AI-generated content may contain errors, omissions, unsafe recommendations, or other limitations.
7.7 AI-generated workouts, timers, configurations, and other workout-related outputs are treated as user-generated workout-related content for purposes of these Terms and are expressly subject to Section 6 (Health & Fitness Disclaimer) and Section 8 (User Content).
7.8 GymNext does not review, monitor, verify, endorse, or guarantee the accuracy, completeness, safety, effectiveness, or suitability of AI-generated content.
7.9 All disclaimers, assumptions of risk, exclusions of warranties, and limitations of liability in these Terms apply equally to AI Features and any AI-generated content.
8. User Content
8.1 You may create, upload, or generate (including through AI Features) workout configurations or workout-related content within the app.
8.2 You retain ownership of your content.
8.3 By using the Services, you grant GymNext a limited license to store, process, and display your content as necessary to provide the Services.
8.4 User content is limited to workout-related information. You are solely responsible for any content you submit.
8.5 GymNext does not review, monitor, or verify user-generated content.
8.6 We reserve the right to remove content or suspend accounts that violate these Terms.
9. Intellectual Property
All content, software, trademarks, branding, and technology within the Services are owned by GymNext or its licensors.
You are granted a limited, non-transferable, non-exclusive license to use the Services for personal or business fitness purposes.
You may not reproduce, distribute, or modify the Services without written permission.
10. Service Availability
10.1 We may modify, suspend, or discontinue any feature at any time.
10.2 We do not guarantee uninterrupted or error-free operation.
10.3 We may perform maintenance that temporarily affects availability.
11. Termination
We may suspend or terminate your access to the Services at any time:
- If you violate these Terms
- For fraudulent or abusive activity
- If required by law
You may terminate your use of the Services at any time by deleting your account.
Upon termination, your right to use the Services will immediately cease. Any provisions which by their nature should survive termination shall survive, including ownership, disclaimers, and limitations of liability.
12. Disclaimer of Warranties
The Services are provided “as is” and “as available.”
To the maximum extent permitted by law, GymNext disclaims all warranties, express or implied, including:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
13. Limitation of Liability
To the maximum extent permitted by law:
GymNext and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, consequential, or special damages, including but not limited to:
- Loss of profits
- Business interruption
- Data loss
- Personal injury
Our total liability shall not exceed the amount you paid for the Services in the twelve (12) months preceding the claim.
14. Third-Party Services
The Services may integrate with third-party platforms.
We are not responsible for third-party services, content, policies, or functionality.
Your use of third-party services is subject to their respective terms.
15. Privacy
Your use of the Services is also governed by our Privacy Policy, available at:

16. International Use
The Services are operated from Canada.
If you access the Services from outside Canada, you are responsible for compliance with local laws.
17. Modifications to Terms
We may update these Terms at any time.
Continued use of the Services after changes constitutes acceptance of the updated Terms.
18. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.
Any disputes shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
